Terms of Service

Please read these Terms of Service ("Terms") before using CaliPanther. They are an agreement between you and Lotanang Hope Mohlala, trading as CaliPanther ("we", "our", "us"), who operates the CaliPanther app and website ("the App") from South Africa.

1. Acceptance of Terms

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Description of Service

CaliPanther is a calisthenics training app. It provides a guided journey of workouts, timed exercise sessions, progress tracking, achievements, weekly leagues, a public leaderboard, and — on premium — rep counting using your camera. It is available in a free tier and a premium tier.

We may change, add or remove features. If we remove something you are paying for, section 5 explains what happens.

3. Accounts

You must give a valid email address to create an account.
You are responsible for keeping your password safe and for what happens under your account.
Do not share your account, and do not use anybody else's.
We may suspend or close an account that breaks these Terms.

4. Supplier Information

As required by section 43 of the Electronic Communications and Transactions Act, 2002 (ECTA):

5. Subscriptions and Payment

On the web

We sell premium directly. We are the merchant of record, and payments are processed for us by Paystack.
Premium is available as a monthly or annual subscription that renews automatically, or as a single lifetime purchase that does not renew.
The price and billing interval are shown before you pay. A subscription renews at the same price until you cancel.
You can cancel at any time in the app, under Settings → Subscription, or by contacting us at the email above. Cancelling stops the next renewal; you keep premium until the period you have already paid for ends.

On Android

Premium bought inside the Android app is sold through Google Play and charged to your Google account.
Manage or cancel those subscriptions in the Play Store. We cannot cancel them for you.

Refunds

Web purchases: email us within 7 days of your payment and we will refund you in full, provided you have not used premium substantially in that time. Refunds go back to the card you paid with, and a refund ends your premium access.
Google Play purchases: refunds are handled by Google under its own policy, because Google, not us, took the payment.
Nothing here limits any right you have under the Consumer Protection Act, 2008 or ECTA — including the right, where it applies, to cancel an electronic transaction within seven days.

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Try to gain unauthorised access to our systems or to anyone else's account
Interfere with or disrupt the App or the services it runs on
Reverse-engineer, decompile or disassemble the App
Use bots, scripts, modified clients or crafted requests to inflate XP, streaks or leaderboard position
Upload or transmit malicious code

We may reset statistics that were not earned by actually training, and close accounts that do it repeatedly.

7. Intellectual Property

The App — its design, graphics, text, exercise programming and code — belongs to us and is protected by copyright and other intellectual property law. You get a personal, non-exclusive, non-transferable licence to use it. Your workout data belongs to you.

8. Health Disclaimer

Read this one. CaliPanther is a fitness tool, not medical advice, and we are not your doctor, coach or physiotherapist.

Consult a healthcare professional before starting any exercise programme, particularly if you are pregnant, recovering from injury or illness, or have a heart, joint or blood-pressure condition.
Stop immediately if you feel pain, dizziness or shortness of breath, and get medical help.
The camera rep counter counts movement. It does not check your form and cannot tell you whether an exercise is safe for you.
You exercise at your own risk, and you are responsible for judging whether an exercise suits your body and your surroundings.

9. Limitation of Liability

To the fullest extent the law allows:

The App is provided "as is", without warranties of any kind.
We are not liable for indirect, incidental, special or consequential loss, or for lost data or lost profits.
Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by our gross negligence, for fraud, or under the Consumer Protection Act, 2008.

10. Indemnity

You agree to hold us harmless from claims, damages and costs arising from your use of the App or your breach of these Terms.

11. Changes to These Terms

We may change these Terms. When we make a significant change we will post a notice in the App and update the date at the top. Continuing to use CaliPanther after a change means you accept the new Terms.

12. Termination

You may stop using the App and delete your account at any time in Settings. We may suspend or close your access for conduct that breaks these Terms or harms other users. If we close a paid account without cause, we refund the unused part of what you paid.

13. Governing Law and Disputes

These Terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

Before starting any legal proceeding, please email us — most problems are a misunderstanding and are quicker to fix directly. You may also refer a consumer complaint to the National Consumer Commission.
